Kolkata Port Trust Chairman Manish Jain today made a fresh appeal to the Haldia Bulk Terminals, which has already issued its contract termination letter to the port, to resume operation otherwise they might face a huge penalty.
"We think better sense will prevail and they will begin operation. However, if they do not abide by the terms and conditions of the contract and do not resume operation, we'll claim demurrage for the entire contract period," Jain told a press conference.
He said KoPT would wait for the Calcutta High Court's direction before taking further action. Normally, if a contractor fails, then risk purchase clause is activated and for any losses arising out of new financial terms with new contractor, the difference liability lies with the failing contractor, Jain said.
Jain also made it clear that Port Trust would not allow HBT to take away equipment worth about Rs 140 crore. He, however, parried questions about the law and order situation.
